Do not use just any open source.  Use only GPL.  It may be best 
to stall and use GPL-3, or use the draft GPL-3 in the interim.

The BSD license is a gift to the patent holder.  It exposes you 
to significant legal risk.

GPL, especially version 3, gives you a strong position to 
negotiate if there is a legal threat.
